Service provider: Wyrd Events

Client: The person or entity accepting the quotation.

1. Acceptance and booking confirmation

1.1. All bookings are subject to availability and acceptance by Wyrd Events.

1.2. A quotation does not constitute a confirmed booking. A booking is confirmed once the client has accepted the quotation and these Terms and Conditions in writing, and the required deposit has cleared.

1.3. The quotation is valid until the date stated on the quotation. Prices, availability and proposed arrangements may be revised after the validity period.

1.4. The client is responsible for ensuring that all event information supplied to Wyrd Events is accurate and complete.

1.5. Any changes to the event date, venue, package, duration, equipment requirements or agreed services must be requested in writing and are subject to written approval by Wyrd Events. Additional charges may apply.

2. Payment terms

2.1. Unless otherwise stated in the quotation, a 50% deposit is payable to secure the booking.

2.2. The remaining balance must be paid no later than five business days before the event.

2.3. Where a booking is made fewer than five business days before the event, the full quoted amount is payable upon acceptance unless otherwise agreed in writing.

2.4. Wyrd Events reserves the right to withhold performance of the services where a payment due remains outstanding, subject to applicable law and any agreed remedy period.

2.5. Any additional services or expenses must be approved by the client in writing before being incurred.

2.6. Applicable VAT will be charged where legally required and will be reflected in the quotation or invoice.

2.7. A booking is not secured by a verbal promise, an enquiry, or the issue of an unpaid invoice alone.

3. Travel and transport

3.1. The first 20 km of total return travel is included in the standard packages, unless the quotation expressly states otherwise.

3.2. Additional travel is charged at R6.50 per kilometre beyond the included 20 km, calculated using the total return journey from the agreed departure point to the venue and back.

3.3. The applicable travel charge will be stated in the quotation wherever the venue exceeds the included allowance.

3.4. If the venue, event location or agreed route changes after quotation acceptance, Wyrd Events may issue a revised travel quotation. Additional charges require the client's written approval before being incurred.

3.5. Parking fees, toll fees, accommodation or other exceptional travel expenses are excluded unless expressly included in the quotation. Any additional expense must be disclosed and approved by the client in advance.

3.6. The client must provide accurate venue details and advise Wyrd Events of any access restrictions, security procedures, parking arrangements or other conditions that could materially affect arrival and setup.

4. Service scope and event duration

4.1. Wyrd Events will deliver the package and services expressly identified in the accepted quotation.

4.2. The Classic Quiz consists of five rounds of 11 questions each, including the specified music challenge in questions 10 and 11.

4.3. The 50/50 Challenge consists of five rounds of 11 questions each, with the agreed balance of general knowledge and company-specific content.

4.4. The Ultimate Team Challenge includes the 50/50 Challenge and the agreed bingo mini-game.

4.5. The Musicology Special will follow the game format, duration and activities agreed in the quotation or accompanying written event brief.

4.6. Company-specific questions depend on the information supplied and approved by the client by the agreed preparation deadline. Wyrd Events is not responsible for inaccuracies in client-supplied information.

4.7. Any additional rounds, custom games, extended hosting, prizes, printing, specialised equipment or other services are excluded unless expressly included in the quotation.

4.8. The host's arrival and setup time, event start time and expected completion time must be agreed in advance.

4.9. Delays caused by the client, venue, attendees or other third parties may affect the delivery and duration of the programme. Wyrd Events will make reasonable efforts to accommodate delays, subject to scheduling and other commitments. Additional time is not guaranteed and may incur an agreed additional fee.

5. Equipment and technical requirements

5.1. Wyrd Events will supply the standard equipment identified in the accepted quotation, which may include a speaker, extension lead and general quiz equipment.

5.2. Equipment supplied remains the property of Wyrd Events or the relevant equipment owner. The client does not acquire ownership of any supplied equipment.

5.3. The client must provide a suitable, safe and reasonably secure area for the host and equipment, with appropriate access to the event space.

5.4. For the Musicology Special, the client must provide a functioning television with a compatible HDMI connection or a suitable projector and screen, as agreed before the event.

5.5. The client is responsible for confirming the availability, functionality and compatibility of venue-provided equipment before the event. Wyrd Events is not responsible for venue equipment failures outside its reasonable control.

5.6. Where a technical issue prevents the agreed programme from being delivered, the parties will make reasonable efforts to find a practical alternative. Any material change to the service will be discussed with the client.

5.7. The client must notify Wyrd Events of venue restrictions concerning sound levels, electrical connections, equipment placement and access before the event.

6. Care of equipment and damage

6.1. The client must take reasonable steps to prevent supplied equipment from being stolen, misused, tampered with or damaged by attendees, venue staff or other persons under the client's control.

6.2. The client must notify Wyrd Events promptly of any incident involving supplied equipment.

6.3. Where equipment is lost or damaged through the negligent, unlawful or wilful conduct of the client or persons for whom the client is legally responsible, the client may be liable for the reasonable, evidenced cost of repair or replacement, subject to applicable law.

6.4. Any claim for repair or replacement must be supported by reasonable evidence of the damage, the cause where ascertainable, and the associated cost. The client will not be charged for ordinary wear and tear or pre-existing damage.

6.5. The client is not automatically liable for damage caused by Wyrd Events, its personnel, ordinary wear and tear, or circumstances for which the client is not legally responsible.

6.6. Wyrd Events may remove its equipment from an unsafe environment or where there is a reasonable risk of damage, theft or misuse. Where practicable, the host will notify the client's designated representative and seek to resolve the issue first.

7. Client responsibilities

7.1. The client must ensure that the venue is accessible at the agreed times and that the host has sufficient time to set up and test the equipment.

7.2. The client is responsible for venue booking, attendee management, venue permissions, food and refreshments, security and any other arrangements not expressly included in the quotation.

7.3. The client must nominate an on-site representative who can assist with event coordination and make decisions on the client's behalf where reasonably necessary.

7.4. The client must ensure that attendees behave in a lawful and respectful manner and comply with reasonable venue safety requirements.

7.5. Any company documents, photographs, logos, product information or other materials supplied for customised content must be provided with the necessary permissions and must not unlawfully disclose confidential or personal information.

8. Conduct, safety and right to suspend or terminate

8.1. Wyrd Events expects professional, respectful and safe conduct from the client, attendees and venue personnel.

8.2. The host may pause or suspend the programme where there is a material safety concern, threatening or abusive behaviour, harassment, unlawful activity, serious interference with the equipment, or a substantial breach of the agreed event arrangements.

8.3. Where reasonably practicable, the host will notify the client's designated representative and allow an opportunity to remedy the situation before suspending the service.

8.4. Wyrd Events reserves the right to refuse a requested activity or instruction that is unlawful, unsafe, discriminatory, abusive, or materially outside the agreed service.

8.5. If a serious or continuing safety risk or material breach cannot reasonably be resolved, Wyrd Events may terminate the service. The parties will assess any refund, outstanding payment or other remedy in accordance with the circumstances, the agreed contract and applicable law.

8.6. Wyrd Events will not terminate a booking arbitrarily or use this clause to avoid its contractual obligations.

9. Cancellation by the client

9.1. A cancellation must be submitted in writing by the person who made or authorised the booking.

9.2. The following is the proposed cancellation schedule, subject to applicable law and any mandatory consumer cancellation rights:

  • More than 14 calendar days before the event: refund of amounts paid, less reasonable, documented and non-recoverable costs already incurred for the booking.
  • Between 7 and 14 calendar days before the event: a proposed cancellation charge of up to 25% of the total booking fee.
  • Fewer than 7 calendar days before the event: a proposed cancellation charge of up to 50% of the total booking fee.

9.3. Cancellation charges must be reasonable in the circumstances and must not exceed any amount lawfully recoverable. The schedule does not remove statutory rights that apply to the client or booking.

9.4. If Wyrd Events can recover the date by securing a replacement booking, that fact may be considered when determining any cancellation amount where required by law.

9.5. Any refund due will be processed within a reasonable period after the applicable cancellation amount has been determined.

10. Postponement and changes to the date

10.1. Requests to postpone an event must be submitted in writing and are subject to availability.

10.2. Where a new date is agreed, payments already made may be transferred to the replacement booking by written agreement, subject to reasonable costs already incurred and applicable law.

10.3. A postponement is not confirmed until Wyrd Events has accepted the new date in writing.

10.4. Any additional costs resulting from a change of date, venue, travel requirements or service scope will be communicated to the client for approval.

11. Cancellation or non-performance by wyrd events

11.1. If Wyrd Events cannot perform the agreed service for a reason within its reasonable control, it will notify the client as soon as reasonably practicable and discuss an appropriate solution.

11.2. Where Wyrd Events cancels and cannot provide an agreed replacement service or date acceptable to the client, amounts paid for services not delivered will be refunded, subject to applicable law and any other rights available to the client.

11.3. Wyrd Events will not retain payment for services not delivered where a refund is required by law.

12. Force majeure and unforeseen events

12.1. Neither party will be treated as having breached the agreement to the extent that performance is prevented by an event beyond its reasonable control, such as a natural disaster, severe transport disruption, government restriction, serious emergency or other comparable event.

12.2. The affected party must notify the other party as soon as reasonably practicable and take reasonable steps to limit the effects.

12.3. The parties will first attempt to agree on postponement or an alternative method of delivering the service.

12.4. If the event cannot reasonably proceed, the parties will determine any refund, credit or unavoidable cost allocation in accordance with applicable law and the circumstances. This clause does not automatically entitle either party to retain all amounts paid.

13. Liability

13.1. Each party remains responsible for its own acts, omissions and legal obligations.

13.2. Wyrd Events will exercise reasonable care and skill in providing the agreed services.

13.3. Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct or other liability that cannot lawfully be excluded.

13.4. Subject to applicable law, Wyrd Events is not responsible for losses arising from venue closures, third-party equipment failure, attendee conduct or other circumstances outside its reasonable control, except to the extent that Wyrd Events is legally responsible.

13.5. Any limitation of liability must be reasonable, proportionate and consistent with applicable law. No clause in these terms removes a client's statutory rights.

14. Intellectual property and recordings

14.1. Quiz questions, original game formats, written materials, presentation files and other original content created or supplied by Wyrd Events remain the intellectual property of their respective owners unless otherwise agreed in writing.

14.2. The client may use the supplied materials for the agreed event but may not reproduce, distribute, resell, publish or use them commercially without prior written permission.

14.3. Company logos, trademarks and materials supplied by the client remain the property of their respective owners. The client confirms that it has permission to provide such materials for the agreed purpose.

14.4. Neither party may use the other party's name, logo or event photographs for promotional purposes without the necessary permission.

14.5. The client is responsible for obtaining any permissions required for recording or photographing attendees, subject to applicable privacy and data-protection law.

15. Music and third-party rights

15.1. Any music playback or audiovisual content used in the Musicology Special is subject to the relevant copyright, licensing and venue requirements.

15.2. The client must disclose any venue-specific restrictions affecting music playback or audiovisual equipment.

15.3. Responsibility for obtaining event-specific music or public-performance licences must be agreed in writing before the event, taking into account the applicable law, venue arrangements and the parties' respective roles.

15.4. Wyrd Events does not warrant that a venue's existing licences cover every proposed use of music or audiovisual content.

16. Privacy and confidentiality

16.1. Each party must handle personal information received in connection with the booking responsibly and in accordance with applicable privacy and data-protection laws.

16.2. Confidential company information provided for a customised quiz must be used only for the agreed purpose and must not be disclosed unnecessarily.

16.3. The client should not supply sensitive personal information or confidential business information that is not necessary for the agreed event.

17. Disputes and governing law

17.1. The parties will first attempt to resolve any dispute through good-faith discussions between their authorised representatives.

17.2. If the dispute cannot be resolved informally, either party may pursue the remedies available under applicable South African law.

17.3. These terms are governed by the laws of the Republic of South Africa, subject to applicable mandatory legal provisions.

18. Entire agreement and amendments

18.1. The accepted quotation, these Terms and Conditions and any written event brief expressly incorporated into the booking form the agreement between the parties.

18.2. Where a specific provision in the quotation conflicts with these general terms, the parties must resolve the inconsistency in writing before the event. Any agreed special condition must be clearly recorded in the accepted quotation or a signed addendum.

18.3. Amendments to the booking must be recorded in writing and accepted by both parties.

18.4. If a provision is found to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

19. Client acknowledgement

By accepting the quotation, the client confirms that they have had the opportunity to read these Terms and Conditions, understand the booking arrangements and agree to the terms that are legally applicable to the transaction.
